Insufficient protection for live sport game broadcasting

Uncertainty remains in China as to whether live sports broadcasting (LSB) should be regarded as "audio-visual work" (i.e. having originality, which would see more protections under Copyright Law) or as a video recording, (i.e. having little originality), which results in insufficient protection under the Chinese Copyright Law. Although the revised Copyright Law and the recent judicial trend is more likely to take LSB as audio-visual work, in practice there is still uncertainty, in addition to other ongoing challenges in the wider copyright protection area, including a high burden of proof in enforcement.
